Bill seeks to penalize irresponsible parents

QUEZON CITY, METRO MANILA– House Bill 5322, filed by You Against Corruption and Poverty (YACAP) Partylist Representative Carol Lopez, seeks to penalize and prosecute parents who failed to perform their duties to their children.

Under the proposed law, the acts to be considered as crimes are failure of parents or guardians to provide proper education to their minor children, allowing their children to loiter, play or wander unsupervised in public, in motor vehicles, in traffic, and accident prone areas like streets.

“It is easy to become a parent but it is very difficult to act as a parent,” stressed Lopez.

The bill aims to encourage parents to spend more time with their children and be more attentive to their  needs. Violators can face a jail term of four years and a fine of not more than P60,000 or both at the discretion of the court.

The bill also includes penalty for parents or guardians who fail to secure their firearms,  which can be accessed by minors and used for criminal activities. The crime committed by the minor will also be imposed upon the guardian, who will also undergo counseling by the Department of Social Welfare and Development (DSWD).

The bill also seeks to criminalize the failure of parents to seek assistance or intervention to “children at risk” with community-based programs under the government’s juvenile justice and welfare system.

Parents should also comply with the appropriate diversion programs established by the local social worker that deals with cases of children in conflict with the law.

Parents who would fail to prevent the minor from being a member of street gang can also face imprisonment of more than 16 years and a fine of not more than P80,000.
